SANDHAWALIA, J.(Oral) Civil writ petition has been filed under Article 226 of the Constitution of India for issuance of a writ in the nature of mandamus to consider the claim of the petitioner for promotion as Principal/Deputy Director HES-I (Group-A) w.e.f. 02.07.2020 when junior to her was promoted.

Counsel for the petitioner submits that though the petitioner was promoted on 21.06.2019 (Annexure P-1) and posted at Government College, Radaur (Yamuna Nagar) but she did not join as such. He submits that as per clause-8, she was not liable to be considered for promotion for at least for one year. Resultantly, the application (Annexure P-2) had been filed on 05.06.2020 for consideration of her promotion and giving the place SACHIN MEHTA 2021.07.08 17:39 I attest to the accuracy and authenticity of this document High Court, Chandigarh

CWP-12022-2021 -2of posting in Panchkula District against vacant post at Government College, Kalka. It is submitted that now the juniors have been promoted on 02.07.2020 and the petitioner has not been granted the said benefit. Her representation dated 03.03.2021 (Annexure P-5) has already been filed, followed up by another representation dated 25.06.2021 (Annexure P-6). During the course of arguments, it transpires that petitioner is going to retire on 31.08.2021.

Keeping in view the limited prayer raised, it would be expedient to direct that the case of the petitioner for promotion as Principal be decided expeditiously by respondent No.2, keeping in mind that her juniors have been promoted vide order dated 02.07.2020. The said exercise be completed within a period of three months from the date of receipt of this order.
