The prayer made in the present petition is for challenging the orders dated 17.05.2006 and 15.06.2015 and for directing the respondents to appoint the petitioner as Constable on compassionate basis. 2.

The father of the petitioner posted as Constable, having belt No.2252/FZR in District Ferozepur, unfortunately passed away in harness on 20.09.2003. The petitioner at that time was 15 years and 9 months old and after completion his matriculation in 2005, submitted an application for appointment on compassionate basis in the year, 2006, which was rejected on 30.05.2006 on account of the fact that he did not have the requisite qualification for appointment to the post of constable, regarding which learned counsel has placed reliance on Annexure P-4, stating therein that the relaxation had been granted in age and height for certain candidates to be appointed on compassionate basis on the post of constable, however, cannot advance the case of the petitioner, in wake of the fact that there is nothing that have been shown during the course of arguments that MOHIT 2025.03.05 17:01 I attest to the accuracy and integrity of this document

educational qualification for appointment to the said post, could be relaxed. 3.

Further that the petitioner had already got the benefit of post of ClassIV employee on compassionate grounds as stated in para 11 of the reply filed by way of affidavit of Superintendent of Police (Headquarter), District Ferozepur dated 30.03.2022, a fact not rebutted by filing any replication and once the right is consummated, any further or second consideration for higher post on the ground of compassion would not arise as held in State of Rajasthan v. Umrao Singh, 1995(1) SCT 46 by Hon'ble the Supreme Court.
