JASGURPREET SINGH PURI , J. (Oral) The present petition has been filed under Section 482 of the Code of Criminal Procedure, for issuance of appropriate directions to respondent Nos.2 and 3 to submit the status report with regard to complaint/representation dated 12.3.2021 (Annexure P-2) and further for taking action against the private respondents by conducting proper and fair investigation of the case.

On 23.8.2021, the learned State counsel had submitted that the representation of the petitioner was considered by the police and

even the orders have been passed in this regard and therefore, he had prayed for some time to place on record copy of the orders passed by the police authorities.

Today, learned State counsel has submitted that the copy of orders passed by the Superintendent of Police, Panipat along with translated copy of the same has been sent through email since the matter is being taken up through video conference. A print out of orders Annexures R1 and R2, is directed to be taken on record. As per the orders passed by the Superintendent of Police, Panipat, an enquiry was conducted and both, complainant Dharambir and Jitender (petitioner) have the dispute about transaction of money pertaining to the car and both the parties levelled allegations and counter allegations against each other but there is no truth in the complaint of both the parties and furthermore, present petitioner namely Jitender was called by the SI and SHO multiple times to join in the enquiry but he has not appeared nor he has accepted any notice. Detail of respondent --- Detail of enquiry. The subjected cited complaint has been enquired by SHO,PS, Israna, District Panipat. During enquiry, complainant Dharambir was joined in

the enquiry and his statement was recorded. Arun Kumar, Sarpanch of the Village Dahar, has also been joined in the enquiry about the complaints and his statement was also recorded. The complainant Dharambir and Jitender have the dispute about transaction of money pertaining to the car. Both the parties are levelling allegations and counter allegations against each other and they have also been filing the complaints to make pressure. There is no truth in the complaints of both the parties. Jitender was called by SI and SHO multiple times to join in the enquiry, but he has not appeared inspite of repeated calls and he has also not accepted any notice. There is no truth in the complaints.

After going through the orders passed by the Superintendent of Police, Panipat, this Court is of the opinion that the present petition is devoid of any merits and therefore, no further directions can be issued to the Police in view of the orders passed by the Superintendent of Police, Panipat and no case is made out for exercising the extra ordinary power under Section 482 Cr.P.C. Consequently, the present petition is hereby dismissed.
