AT CHANDIGARH CRM-M-22148-2024 (O&M) Date of order: 06.05.2024 Jitender Kaushik ... Petitioner(s)

Versus

State of Haryana & others

...Respondent (s)

CORAM:

HON'BLE MR. JUSTICE ANOOP CHITKARA Present:- Mr. Kunal Dawar, Advocate for the petitioner(s). Mr. Rajat Gautam, Addl.A.G., Haryana.

*** ANOOP CHITKARA, J.

1.

Seeking directions to the respondents to serve at least 7 days advance notice to the petitioner in case he is required to be arrested in any criminal case, the petitioner has come up before this Court by filing the present petition under Section 482 CrPC. 2.

After arguing for some time, but facing stiff opposition from the State of Haryana, counsel for the petitioner wants to withdraw the present petition with liberty to exercise his statutory right under Section 438 CrPC. He submits that in case he is so advised, he be permitted to file a petition for anticipatory bail straightaway before this Court and he shall not claim any prejudice for not availing one statutory remedy of concurrent jurisdiction of this Court, which is also accompanied with supervisory jurisdiction under Article 227 of the Constitution of India. 3.

Given such concession by the petitioner, the present petition is disposed of as withdrawn, with liberty to file separate petition(s) for anticipatory bail in each FIR detailed in para no.8 of the petition. It is clarified that in case the petitioner files such petition(s) before this Court, he shall not claim any prejudice for losing his right to file petition(s) before the Sessions Court.

Petition disposed of, as withdrawn with liberty as aforesaid. All pending applications, if any, stand disposed.
