Tribhuvan Dahiya, J (Oral) The petition has been filed seeking a writ of mandamus directing the respondent-Department to consider and promote the petitioner on the post of PGT-English, w.e.f. 13.04.2022, i.e., the date when his juniors were so promoted.

It is contended that the petitioner fulfills all the requisite qualifications, including the experience on the date his juniors were so considered and promoted. His case has been denied consideration for no valid reasons. Even the representation submitted in that regard, dated 16.08.2023, Annexure P-5, remains undecided.

Mr. Sanjeev Kaushik, Additional Advocate General, Haryana, accepts notice and submits that in case the petitioner is eligible and AVIN KUMAR 2024.05.03 14:13 I attest to the accuracy and integrity of this judgment/order.

In view thereof, without commenting anything on the merits of the case, the petition stands disposed of directing respondent No.2 to decide the pending representation of the petitioner, dated 16.08.2023, by passing a speaking order in accordance with law, within a period of six weeks from the date of receiving certified copy of this order. In case the petitioner is found entitled to be promoted, necessary order to that effect will be passed within four weeks thereafter.
