The present revision petition has been filed under Article 227 of the Constitution of India, seeking issuance of a direction to the learned Trial Court to decide the application for injunction under Order 39 Rules 1 and 2 of the Code of Civil Procedure, 1908. A further prayer has also been made for expeditious disposal of Civil Suit bearing No. CS-1165-2021 in a time-bound manner.

Learned counsel for the petitioner submits that respondent No.1/plaintiff had instituted a suit for declaration against the petitioner/defendant. It is further submitted that the petitioner/defendant filed the written statement as well as reply to the injunction application on 07.09.2022; however, despite the lapse of more than three years, the said injunction application has not yet been decided by the learned Trial Court. Learned counsel further submits that the suit was instituted in the year 2021 and, owing to repeated and unnecessary adjournments, the proceedings -1-

have been unduly delayed and the suit has not been decided till date. It is contended that, through the present petition, the petitioner seeks only a direction to the learned Civil Judge (Junior Division), Charkhi Dadri to decide the pending injunction application as well as the suit within a timebound period. 3.

I have heard learned counsel for the petitioners at length and have perused the paper-book.

In view of the nature of the order proposed to be passed, issuance of notice to the respondents is dispensed with, as the same would only delay the proceedings and entail unnecessary expense. 5.

Considering the averments made in the petition, the present revision petition is disposed of without expressing any opinion on the merits of the case. The learned Civil Judge (Junior Division), Charkhi Dadri is directed to decide the application under Order 39 Rules 1 and 2 CPC filed by respondent No.1/plaintiff within a period of one month from the date of receipt of a certified copy of this order, in accordance with law. The learned Trial Court is further directed to make an endeavour to dispose of Civil Suit bearing No. CS-1165-2021 as expeditiously as possible. 6.

The Registry is directed to forward a copy of this order to the learned Civil Judge (Junior Division), Charkhi Dadri for compliance. 7.
