The petitioners having been summoned as additional accused u/s 319 Cr.P.C. and they having complied with the interim order passed by this court, they can be granted the concession of pre-arrest bail as the dual version has already cropped up, they having been found innocent during the initial investigation.

The petition is allowed and interim order dated 15.12.2014 is hereby made absolute. The petitioners will remain on bail against the bail bonds already furnished, subject to a condition that they will continue to appear before the trial court and will not absent themselves without any sufficient cause. They will not, in any manner, delay the proceedings by evading appearance. Nothing mentioned in this order will prejudice the right of the prosecution agency.
