(Oral) The allegations against petitioner Dilbag Singh in this anticipatory bail are that he happens to introduce Rekha alias Reshma, a lady to her clients co-accused Sandeep, Harpal and Sonu who all were apprehended.

The contentions of the counsel for the petitioner are that only semblance of evidence against the petitioner is statement of co-accused and that nothing is to be recovered from the petitioner. Though on behalf of the State, learned State counsel has sought to oppose the grant of bail who has fairly conceded at the bar that neither there is any allegations of having acted as a pimp nor any role is attributed to the petitioner except that statement of co-accused that he used to introduce the accused to the lady, thus, there is a debatable issue as to the validity and legality of such a statement of the co-accused.

Criminal Misc. No. M-43392 of 2016 -2In view of the aforesaid, the present petition is allowed. In the event of arrest, the petitioner shall be released on bail to the satisfaction of arresting/investigating officer till submission of report under section 173 Cr.P.C. (challan). The petitioner shall, however, join the investigation as and when called for and shall also abide by the conditions specified under section 438 (2) Cr.P.C. Thereafter, petitioner will be permitted to furnish regular bail bonds to the satisfaction of the trial Court. ( Fateh Deep Singh ) February 13, 2017 Judge 'tiwana'
