Petitioner accompanied by seven other co-accused came to the tea shop of complainant-Anil at 1.30 am on 24.5.2015, and on account of previous dispute gave beating to complainant and his nephew injured Sunil.

It is contended that role attributed to the petitioner Pardeep @ Naad is of giving slaps to Sunil as also of holding the complainant while others inflicted injuries upon him.

It is contended that the petitioner is in custody since 11.8.2014 and after investigations case is at the stage of framing of RAJINDER PRASHAD JOSHI 2016.01.15 11:07 I attest to the accuracy and authenticity of this document High Court, Chandigarh.

Learned State counsel on instructions from ASI Satbir Singh does not refute the custody period also also the fact that the case is now fixed for framing of charge on 15.1.2016. In view of the above, without expressing anything on the merits of the case, and also keeping in view the fact that the challan has been presented and the trial is not likely to be concluded in near future and no useful purpose would be served by keeping the petitioner in custody, the present petition is allowed and petitioner is directed to be released on bail subject to the satisfaction of CJM/Duty Magistrate,Bhiwani.
