This is a petition filed under Section 438 Cr.P.C. seeking anticipatory bail in a case registered against the petitioner vide FIR No. 188 dated 20.06.2013 under Sections 409, 201 IPC at Police Station Madhuban Karnal.

Learned counsel for the petitioner has vehemently contended that petitioner has submitted before the investigating agency and cooperated in every manner. Thus, he deserves to be released on pre-arrest bail.

Learned State counsel has, however, opposed the plea. According to him, allegation against the petitioner is that he has not handed-over about seventy five registers of the Panchayat in order to hide his mis-deed. He further, on instructions from ASI Ved Pal, who is present in court, submits that pursuant to order dated 12.12.2014, petitioner joined investigation but refused to cooperate. I have heard learned counsel for the parties. It is evident that a FIR was registered against the petitioner on the complaint of DDPO, Gharaunda. It was alleged that petitioner was guilty of misappropriation and destruction of relevant record of the Gram Panchayat. He requested that a case be registered against Sarpanch Shakhar Rana (petitioner herein) and relevant record be recovered from him. Pursuant to the complaint, instant FIR was registered and investigating agency sought to arrest the petitioner. Pursuant to interim bail granted by this court, he joined investigation. However, stand of the State is that he refused to cooperate.

Under the circumstances, there is no ground to grant the discretionary relief of pre-arrest bail to the petitioner. Dismissed.
