Bhandari, AA, Punjab ***** SANJEEV PRAKASH SHARMA, J (ORAL) This is a petition filed under Section 439 Cr.P.C. for seeking regular bail in FIR No.34 dated 21.01.2023 (Annexure P-1) registered under Section 376, 312, 336, 417 IPC registered at Police Station Dera Bassi, District SAS Nagar, Mohali.

Learned counsel for the petitioner has submitted that the statement of the prosecutrix have been recorded under Section 164 Cr.P.C. (Annexure P-3). He further submits that proxecutrix is 30 years old married lady and she had voluntarily in relationship with the petitioner and there was no element of force when the petitioner had physical relationship with the concerned prosecutrix.

CRM-M-22794 of 2023 -22023:PHHC:068334 I have considered the submission made by the counsel for the petitioner and taking into considerations other aspect that the petitioner is no more required in the further investigation, I am inclined to grant bail to the petitioner subject to furnishing of bail bond and surety bond of Rs.50,000/-. Accordingly, the petition stands allowed.
