In the present petition, the challenge is to the impugned order dated 27.07.2023 (Annexure P-1) passed by Respondent No. 2, i.e., the Armed Forces Tribunal, Regional Bench, Chandigarh (hereinafter referred to as "the Tribunal"), whereby the Original A pplication, being OA No. 4093 of 2018, has been allowed and directions have been issued to the petitioners to release the pensionary benefits in favour of Respondent No. 1 by stepping up her pension in view of the revised pay scales and pension rules applicable w.e.f. 01.01.2019, along with interest.

At the very outset, learned counsel for the petitioners submits that the judgment dated 15.07.2024 passed by this Court in CWP No. 7794 of 2013, titled as Nirmal Singh versus Union of India and others, which has been relied upon by the Tribunal while passing the impugned order dated 27.07.2023 (Annexure P-1), is not applicable in the facts and circumstances of the present case, hence, the present petition may kindly be disposed of having been not pressed any further with liberty to file review application before the Tribunal.
