Prayer in this writ petition filed by the petitioner under Articles 226/227 of the Constitution of India, is for issuance of a writ in the nature of mandamus, directing the respondents to release the remaining amount of service-cum-retirement dues of the petitioner including gratuity, leave encashment, provident fund, revised pay-scale and all other benefits along with interest on delayed payment, for which a legal notice dated 19.12.2023 (Annexure P-3), has already been served by the petitioner upon the respondents.

Learned counsel for the petitioner, at the very outset, confines his prayer for deciding legal notice dated 19.12.2023 (Annexure P-3). He submits that at this stage, petitioner would be satisfied, if the said legal notice is decided by passing a speaking order within a time bound frame.

Mr. Rajesh Sehgal, Addl. A.G., Punjab, accepts notice on behalf of respondents No.1 and 2 and on the asking of the Court Mr. Shobhit Phutela, Advocate, who is on the panel of Department of Local Government, Punjab, has accepted notice on behalf of respondent No.3 and have no objection to the innocuous prayer made by learned counsel for the petitioner.

I have heard learned counsel for the parties and have gone through the record of the case.

Without going into the merits of the case at this stage, this writ petition is disposed of with a direction to respondent No.3 to decide legal notice dated 19.12.2023 (Annexure P-3) expeditiously, submitted by the petitioner by passing a speaking order, preferably within a period of 03 months from receipt of certified copy of this order.
