Prayer in this writ petition filed by the petitioner under Articles 226/227 of the Constitution of India, is for issuance of a writ in the nature of mandamus, directing the respondent No.2 to decide the appeal dated 12.04.2024 (Annexure P-2) filed by the petitioner against the punishment order dated 15.03.2024/18.03.2024 (Annexure P-1), passed by respondent No.1, imposing recovery of Rs.3,46,091/-, upon the petitioner.

Learned counsel for the petitioner relies upon order dated 02.04.2024 (Annexure P-4) passed by this Court in CWP-7409-2024 and prays for deciding the appeal filed by the petitioner dated 12.04.2024 (Annexure P-2) expeditiously by passing a speaking order in a time-bound manner.

CWP No.10025 of 2024 (O&M) 2024:PHHC:060305 submits that the appeal filed by the petitioner shall be decided expeditiously.

I have heard learned counsel for the parties and have gone through the record of the case.

In view of the aforesaid stand of the learned counsel for the respondent No.1, the present petition is disposed of with directions that the appeal dated 12.04.2024 (Annexure P-2) pending before the Appellate Authority shall be decided within a period of 06 months from the date of receipt of certified copy of this order. Further recovery from the petitioner shall remain stayed and would be subject to the final order that may be passed by the Appellate Authority. 7.

The petition stands disposed of.
