M.M.S. BEDI, J (ORAL) Petitioner seeks concession of regular bail in a case registered at the instance of Rajwinder Singh alleging that pursuant to an altercation of deceased Gurwinder Singh and petitioner, the petitioner along with other armed persons attacked the complainant by going to his house. Co-accused of the petitioner Harjit Singh allegedly fired a shot with 12 bore gun hitting the father of the complainant as well as the complainant whereas brother of the complainant ran for safety. Co-accused Gurpreet Singh gave kirpan blow on the person of the deceased. Harjit Singh had fired with his 12 bore gun.
So far as the petitioner is concerned, he has not been attributed any injury though he allegedly fired in the air and raised lalkara to teach the deceased a lesson. RAJ KUMAR ARORA 2015.02.06 16:12 I attest to the accuracy and integrity of this document
CRM-M-42657-2014 (O&M) Taking into consideration the fact that co-accused of the petitioner Harpreet Singh who had not been attributed any injury has been released on bail pursuant to the directions of this Court on the principal of parity, the petitioner also can be granted the same relief being in custody w.e.f 16.1.2013. The complainant and other eye witnesses have already been examined. Chance of tampering with the evidence is remote.
The petition is allowed. The petitioner is ordered to be released on bail on his furnishing bail bonds/surety bonds to the satisfaction of the trial Court subject to the conditions that the petitioner will not make any attempt to browbeat the witnesses or tamper with the evidence.
