Instant petition has been filed under Articles 226/227 of the Constitution of India seeking a writ of mandamus directing the respondents to consider and appoint the petitioner w.e.f. the date candidates were selected and appointed in pursuance to the advertisement dated 28.02.2020 (Annexure P-1) to the posts of Punjabi Master/Mistresses, along with all consequential benefits. Further prayer has been made for directing the respondents to grant the benefit of 6th Pay Commission which stands implemented after the judgment dated 13.09.2024 (Annexure P-23) in CWP-15896 of 2023 - Saurabh Sharma and others v. State of Punjab and another, which has been upheld upto the Hon'ble Supreme Court, in respect of similarly situated employees to the petitioner and the instructions dated 15.07.2022 issued by the Government.

Learned Senior counsel for the petitioner submits that to claim the aforesaid benefit petitioner has served legal notice dated 20.09.2025 (Annexure P-25) upon the respondents, however, neither the RAVINDER SINGH 2026.04.09 18:43 I agree to specified portions of this document

CWP-10746 of 2026 same has been replied nor the said benefits have been released to the petitioner. Learned Senior counsel for the petitioner confines his prayer for deciding legal notice dated 20.09.2025 (Annexure P-25) and submits that at this stage, petitioner would be satisfied, if the said legal notice is considered and decided by passing a speaking order in a time-bound frame.

Mr. Swapan Shorey, DAG, Punjab, accepts notice on behalf of the respondents and has no objection to the innocuous prayer made by learned Senior counsel for the petitioner. 5.

I have heard learned counsel for the parties and have gone through the record of the case.

Without expressing any opinion on the merits of the case or the claim being made by the petitioner in the present petition, respondent No.3 is directed to consider and decide the claim made by the petitioner in the legal notice dated 20.09.2025 (Annexure P-25) in accordance with law, by passing a speaking order within a period of three months from the date of receipt of certified copy of this order. In case, the petitioner is found entitled, necessary benefits be released within a period of one month thereafter.

The petition stands disposed of.
