Petitioner No.1-Bhinder Kaur, aged 31 years and Petitioner No.2-Gobind Singh, aged 27 years have filed instant petition for seeking direction to respondents No.1 to 3 for protection of their lives and liberty, which is stated to be at risk at the hands of respondent No.4 - Kulwant Kaur, and respondent No.5 - Jarnail Singh, who are mother and brother of petitioner No.1.

Counsel for the petitioners submits that petitioner No.1 was earlier married to one Parminder Singh, who expired on 16.10.2022, and in support of his contention, he refers to the death certificate of said Parminder Singh, which is appended as Annexure P-4 along with present petition, which is issued by the office of Chief Registrar (Birth and Death), Punjab, in Distt. Ludhiana.

Counsel for the petitioners further submits that petitioner No.2, was also earlier married to one Jyoti Rani, d/o Gurbakhsh Singh, r/o Village Paharhpur, Tehsil Samana, Distt. Patiala, however, who has not been JAWALA RAM 2023.05.08 18:33 I attest to the accuracy and integrity of this document

2023:PHHC:065395 CRWP-4404-2023 - 2 - impleaded as party/respondent in the present petition. Three children were born to petitioner No.1 from her earlier marriage, namely Inderparkash Singh, now aged 13 years, Sahibjot, now aged 07 years and Gurpreet Kaur, now aged 10 years. 4.

Counsel further submits that from the earlier marriage of petitioner No.2 also, one daughter namely Khushpreet Kaur, now aged 07 years was born.

Counsel for the petitioners admits that neither petitioner No.2 has been granted a decree of divorce by the competent Court of law, nor any explanation has been given in the present petition regarding future interests of the children born out of the earlier marriage(s) of both the petitioners. 6.

Faced with the situation, counsel for the petitioners seeks withdrawal of present petition with liberty to file on the same cause of action with better and complete particulars.
