**** HARSIMRAN SINGH SETHI , J. (ORAL) In the present writ petition, the grievance of the petitioners is that they were seniors to one Sh. Jagjit Singh and Smt. Shanta in the cadre of clerks. Sh. Jagjit Singh, who belongs to the reserve category of scheduled caste was promoted on the basis of the reservation prior to the petitioners and they had caught Sh. Jagjit Singh in the cadre of Senior Assistant and thereafter, again in the cadre of Superintendent and therefore, in view of the instructions issued by the Department of Personnel, Government of Punjab dated 14.03.2017 (Annexure P-1), which have been duly adopted by the respondent University, vide resolution dated 23.12.2017 (Annexure P-2), petitioners are entitled for step up of their pay equivalent to Sh. Jagjit Singh, who was their junior in the cadre of Clerks.

CWP-11816-2019 -2Counsel for the petitioners further states that for the relief which has been sought in the present writ petition, the petitioners have served the respondents with a legal notice on 26.11.2018 (Annexure P-8), which is still pending consideration with the respondents and the petitioners will be satisfied, at this stage, in case a time bound direction is issued to the respondents to decide the said legal notice.

In view of the request made, without expressing any opinion on the merits of the case or the claim being made by the petitioners, respondents are directed to decide the legal notice dated 26.11.2018 (Annexure P-8) by passing a speaking order within a period of three months from the date of receipt of a certified copy of this order.

Present writ petition stands disposed of.
