(ORAL) This is a petition that has been filed seeking to challenge the order dated 27.04.2022 (Annexure P-2) whereby the petitioner had been relieved by the Company Commander, Punjab Home Guards, Ludhiana by wrongly considering the date of brith of the petitioner to be 01.05.1964 instead of considering his actual date of birth i.e. 15.07.1964. Learned counsel appearing on behalf of the petitioner herein would contend that he had joined as Home Guard with Identity Card No.394. It is submitted that as per the documents which are in petitioner's possession and in the possession of the respondents, his date of birth had been reflected as 15.07.1964 and therefore, the respondent-State has erred in dispensing with his services, taking his date of birth to be 01.05.1964. Pursuant to notice of motion order, reply has been filed by the respondent-State in which it is stated that the petitioner had been recalled on duty by an order dated 16.06.2022 and on completion of 58 years, he has been relieved from duty on 14.07.2022.

CWP No.11818 of 2022 (O&M) -2counsel for the petitioner does not press the instant petition but would make a prayer that the petitioner should be paid salary/remuneration for the period he remained out of service, considering the fact that he was not at fault. In view of the said prayer, the instant writ petition is disposed of, with a direction to the respondent-State that in case, the petitioner prefers an appropriate representation to the authorities concerned within a period of two weeks from today, the same shall be considered in accordance with law, preferably within a period of two months thereafter.
