Petitioner prays for anticipatory bail in FIR No.182 dated 06.08.2014, under Section 498A IPC, registered at police station Sadar Amritsar, District Amritsar.

It is submitted that on an earlier occasion, FIR No.109 was lodged against the petitioner on similar allegations, which was however, quashed by this Court as settlement had been arrived at between the parties. CRM No.M-42714 of 2014 [2] complainant wife. A petition for restitution of conjugal rights has also been filed. Petitioner is stated to have joined investigation pursuant to interim order dated 17.12.2014.

Learned counsel for the State, on instructions from HC Satinder Pal Singh, submits that the petitioner has indeed joined investigation and he is no longer required for custodial interrogation. No recovery is to be effected from him.

There are no allegations on behalf of the State that petitioner is likely to abscond or that he is likely to dissuade the witnesses from deposing true facts in the Court, if released on bail. In view of the above but without commenting or expressing any opinion on the merits of the case, order dated 17.12.2014 is made absolute. Petition is allowed.
