This order will dispose of two appeals bearing RFA Nos. 1750 and 3854 of 2003, as the same arise out of common acquisition. By filing appeals, the landowners are seeking enhancement of compensation for the acquired land.
Briefly, the facts are that vide notification dated 4.4.1994, issued under Section 4 of the Land Acquisition Act, 1894 (for short, 'the Act'), the Chandigarh Administration sought to acquire 319 kanals 18 marlas of land situated in village Mouli Jagran, Union Territory, Chandigarh, for rehabilitation of Labour Colonies. The same was followed by notification under Section 6 of the Act. The Land Acquisition Collector (for short, 'the Collector') vide award no. 490 dated 18.10.1994 assessed the market value of the acquired land @ ` 3,00,000/- per acre. Dissatisfied with the award of the Collector, the landowners filed objections. On reference, the learned court below determined the market value of the acquired land @ ` 6,33,500/- per acre. This award has been impugned in the present set of appeals by the landowners.

RFA No. 1750 of 2003 (2) involved in the present set of appeals is squarely covered by judgment of this Court in RFA No. 1484 of 2003 Munshi Ram Chhabra (deceased) through LRs vs Land Acquisition Collector, Union Territory, Chandigarh, decided on 22.9.2015, whereby the compensation for the land acquired vide same notification was further enhanced to ` 250/- per square yard. Accordingly, for the reasons recorded in Munshi Ram Chhabra's case (supra), the present appeals are disposed of in the same terms.
