RAJIVE BHALLA, J (Oral) The appellant, filed an appeal, challenging judgment and decree, dated 06.11.2001, dismissing his petition for grant of a decree of divorce.

The appeal came up for hearing on 05.07.2002 and the following order was passed:- "The delay in re-filing the appeal is condoned. There is a delay of 64 days in filing the appeal.

Notice of this application to the respondent. To be listed after the service is complete."

A perusal of the order reveals that notice was issued in the application for condonation of delay and the application was directed to be listed after service is complete.

The notice issued for effecting service upon the respondent was received back with the report, dated 30.07.2002, that the respondent is residing in her in-law's house in Khanpur Bangey. FAO-M-151 of 2002 -2The report appears to suggest that parties have resolved their dispute and are residing together. Consequently, we dismiss the appeal, for non-prosecution.
