NARESH KUMAR SANGHI, J.(ORAL) Prayer in this petition, filed under Section 439, Cr.P.C., is for grant of regular bail to the petitioner, Dinesh Kumar son of Shri Ishwar Singh, resident of village Mohamadpur, Police Station Alipur, Delhi, who has been booked for having committed the offences punishable under Sections 120-B, 398, 401, 420, 467, 468 and 471, IPC, and Section 25 of the Arms Act, registered at Police Station, Barara, District Ambala.

CRM-M-42633-2015 -2Learned counsel contends that the only allegation against the petitioner is that he assisted the main accused to get the forged papers used for arranging the fictitious registration books of the vehicles to be used in a robbery/dacoity. He further contends that the petitioner, who is behind the bars from 20.07.2015, is neither required nor involved in any other case. It was also contended that after completion of the investigation, the charge-sheet (challan) was presented in which it was disclosed that the only material available against the petitioner was disclosure statements suffered by Monu and Navin @ Kabri, the co-accused of the petitioner.

Learned counsel for the State has not controverted the above submissions.

In view of the above, the present petition is accepted. Petitioner- Dinesh Kumar son of Shri Ishwar Singh, resident of village Mohamadpur, Police Station Alipur, Delhi, is ordered to be released on bail, during the pendency of the trial of the present case, subject to his furnishing bail bonds to the satisfaction of learned Chief Judicial Magistrate/ Duty Magistrate, Ambala.
