(ORAL) Prayer in the instant petition under Section 438 Cr.P.C. has been made for grant of anticipatory bail to the petitioner in case FIR No.58 dated 16.10.2017 under Section 420 IPC and Sections 63 and 65 of the Copy Right Act registered at Police Station Purana Shalla, District Gurdaspur. According to the prosecution, on a complaint made on behalf of M/s Asian Paints Limited that spurious/duplicate products are being sold under its name at a large scale by the petitioner, causing wrongful loss to the complainant, cheating the public at large, when raid was conducted at the shop of the petitioner, 20 buckets of spurious products, allegedly, manufactured by the complainant, were recovered.

Learned counsel for the petitioner, drawing the attention of this Court towards the bills/invoices (Annexure P-2 Colly), inter alia contends that the petitioner had purchased the alleged spurious products of the complainant M/s Asian Paints Limited from dealer M/s Guru Nanak Paints Ravinder Singh 2017.11.15 14:40 I attest to the accuracy and authenticity of this document and Hardware Store, Dasuya, against proper bills, making payment through cheques.

-2CRM-M-42700 of 2017 Paints Ltd. and Hardware Store and not the petitioner. Considering overall circumstances and the fact that innocent and poor public at large is cheated by the petitioner, selling spurious products, petitioner does not deserve the concession of anticipatory bail. Dismissed.
