(Oral) Prayer in this petition is for setting aside the order dated 08.03.2022 passed by the Additional Sessions Judge, Jalandhar, vide which bail/surety bonds of the petitioner are cancelled and forfeited to the State, in FIR No.9 dated 14.01.2019 under Sections 392, 379-B IPC, Section 21 of NDPS Act and Section 25 of Arms Act, registered at Police Station Adampur, District Jalandhar Rural.

Learned counsel for the petitioner submits that the petitioner was granted regular bail by this Court vide order dated 23.05.2019 passed in CRM-M-17567-2019 and was regularly appearing before the trial Court, VISHNU 2022.05.30 17:00 I attest to the accuracy and integrity of this document Punjab & Haryana High Court, Chandigarh

CRM-M-24237-2022 -2however, on account of noting a wrong date, he could not appear before the trial Court on 08.03.2022 and his bail/surety bonds were cancelled and forfeited to the State. It is further submitted that the petitioner is ready to surrender before the trial Court and face the trial. Notice of motion.

On asking of the Court, Mr. Joginder Pal Ratra, DAG, Punjab accepts notice on behalf of the respondent-State and has not disputed the factual position.

After hearing learned counsel for the parties and considering the aforesaid submissions, this petition is allowed. The impugned order dated 08.03.2022 (Annexure P-3) is set aside and the petitioner is directed to surrender before the trial Court within a period of 10 days from today and he will be released on bail subject to his furnishing fresh bail/surety bonds to the satisfaction of the trial Court/Illaqa Magistrate, concerned, however, subject to deposit the costs of Rs.5,000/- with the District Legal Services Authority, concerned.
