Petitioner has filed this petition under Section 439 Cr.P.C. for grant of regular bail in case FIR No.364 dated 14.12.2016 under Sections 336, 307 read with Section 34 IPC and Section 25 of the Arms Act, registered at Police Station Sector-39, Chandigarh. Notice of motion.

Mr.G.S.Chahal, Addl. Public Prosecutor, U.T. Chandigarh has put in appearance on behalf of respondent-U.T. Chandigarh and contested the petition.

I have heard learned counsel for the petitioner as well as learned Addl. Public Prosecutor for U.T. Chandigarh and have gone through the record.

As per the FIR, one car hit the car of the complainant parked in the street and when the complainant side asked the driver of that car as to Vineet Gulati 2017.02.14 16:25 I attest to the accuracy and authenticity of this document Chandigarh why he has hit the vehicle, he fled away. The driver of the car again came

CRM No.M-4273 of 2017 -2and when the complainant side tried to stop the vehicle, the driver of that vehicle fired 2-3 shots from the pistol.

It is a no injury case. The present petitioner, as per investigation, is stated to have been sitting in the car along with the driver. The pistol has already been recovered from the driver. The petitioner is in custody since 17.12.2016. He is not required for interrogation or investigation as he is in judicial custody. The trial of the case will take long time. No useful purpose will be served by keeping the petitioner in custody till the disposal of the case. Keeping in view the facts and circumstances of the present case, without discussing the facts in minute detail and without expressing any opinion on the merits of the case, the present petition is allowed and the petitioner is ordered to be released on bail subject to his furnishing personal/surety bonds in the sum of `50,000/- with one surety in the like amount to the satisfaction of the trial Court/Duty Magistrate.
