(ORAL) Prayer in the instant petition under Section 438 Cr.P.C. has been made for grant of anticipatory bail to the petitioner in case FIR No.116 dated 28.10.2016 registered under Section 420 IPC at Police Station Mahilpur, District Hoshiarpur.
According to the prosecution, even after cancellation of the agreement for sale of land measuring 4 kanals 8 marlas in between the complainant and the petitioner and receiving back the amount of ` 3.00 lakh, petitioner got sold the land of the complainant and, thus, cheated and committed fraud with the complainant.
Learned counsel for the petitioner inter alia contends that the instant FIR has been got lodged by the complainant 12 years after the impugned agreement. The complainant never returned ` 3.00 lakh to the petitioner and with mala fide intention got registered the instant FIR. Considering overall facts and circumstances, this Court is not inclined to grant the concession of anticipatory bail to the petitioner. Dismissed.
