(Oral) Present petition has been filed under Section 482 Cr.P.C. for quashing of FIR No.109 dated 23.09.2016, under Sections 406 and 498-A IPC, registered at Police Station Kartarpur, District Jalandhar. On the last date of hearing, learned counsel for the petitioner has sought time to get instructions as to when the petitioner is coming to India for settlement with his wife.

Today, learned counsel, on instructions from petitioner, has informed that if notice of motion is issued and compromise is effected in India, then he can visit India.

After hearing the learned counsel for the petitioner, going through the allegations contained in the FIR, no ground to issue notice of motion is made out, at this stage, as the marriage of the parties has Naresh Kumar 2017.02.07 13:59 I attest to the accuracy and integrity of this document Chandigarh

CRM-M-43621-2016 -2solemnized in the year 2014 and thereafter the petitioner had gone back to Canada whereas his wife is residing in India. Accordingly, the present petition is without any merit and the same is hereby dismissed, at this stage.

However, the petitioner would be at liberty to approach this Court as and when he came to India.
