RAMENDRA JAIN, J. (ORAL) Case has been taken up for hearing through video-conferencing due to Covid-19 pandemic.

Through this petition under Section 439 Cr.P.C. prayer has been made for grant of regular bail to petitioner - Abhilash Sharma - in case arising from FIR No.118 dated 16.11.2019 registered under Sections 15 and 29 of the Narcotic Drugs and Psychotropic Substances Act, 1985 at Police Station Banur, District Patiala.

According to prosecution, in the evening of 16.11.2019, petitioner was apprehended with conscious possession of 150 kgs of poppy husk without any permit or license.

Learned counsel inter alia contends that petitioner has falsely been implicated in this case. He is in custody since 16.11.2019. Conclusion of trial may take a sufficient long time. -2CRM-M-21333 of 2020 by detaining the petitioner in jail any more. Learned counsel relied upon Sandeep Kumar v. State of Punjab, 2020(1) Criminal Court Cases 046 (P&H).

On the other hand, learned State counsel vehemently opposed the grant of regular bail to the petitioner.

Having given thoughtful consideration to the rival submissions and considering huge recovery of poppy husk from the conscious possession of the petitioner, this Court is not inclined to grant regular bail to him.

Facts and circumstances of the aforementioned judgment, relied upon by learned counsel for the petitioner are altogether different from the facts of this case. Therefore, no benefit of the same can be given to the petitioner.

Dismissed.

At this stage, learned counsel for the petitioner prays for withdrawal of this petition.
