CORAM:HON'BLE MS. JUSTICE JAISHREE THAKUR

Present:

Mr. Bhisham Kumar Majoka, Advocate for the petitioner.

Ms. Dimple Jain, AAG, Haryana.

Mr. Y.D. Kaushik, Advocate for the complainant.

-.- JAISHREE THAKUR J. (ORAL) This is a petition that has been filed for grant of regular bail in case FIR No.260 dated 03.06.2019 registered under Sections 323, 324, 307, 506, 34 IPC at Police Station Adarsh Nagar, Ballabhgarh, District Faridabad. Counsel for the petitioner herein inter alia would contend that the petitioner has been falsely implicated in the present case. The petitioner is in custody since 02.07.2019. The challan has been presented and the complainant has already been examined, therefore, the petitioner prays for grant of bail.

Learned counsel appearing for the respondent-State and the complainant oppose the regular bail, while contending that no ground for bail is made out.

I have heard learned counsel for the parties. Keeping in view the fact that the challan has been presented and the complainant has already been examined, coupled with the fact that the

CRM-M No.21393 of 2020 (O&M) -2trial is likely to take some time to conclude as due to COVID-19 situation, Courts are not working at their full strength and not taking up regular hearing matters, no useful purpose would be served in keeping the petitioner behind the bars. The instant petition is allowed and the petitioner is directed to be released on regular bail on execution of adequate personal/ surety bond to the satisfaction of concerned trial Court/Duty Magistrate. However, any observation made herein shall not be construed to be an expression on merits of the case.
