(ORAL) Revision herein is for setting aside impugned order dated 11.05.2010 whereby revision filed by respondent/ accused against order dated 18.08.2009 passed by learned Judicial Magistrate Ist Class, Karnal vide which charge under Section 138 of Negotiable Instruments Act, 1881 (for short 'NI Act') was framed against the respondent, has been accepted and the aforesaid order dated 18.08.2009 was set aside.

Revision was filed way back in the year 2010. Vide order dated 26.07.2011 passed by a co-ordinate Bench of this Court, revision filed by petitioner/ complainant against impugned order dated 11.05.2010 was dismissed for non-prosecution. Thereafter, vide order dated 03.08.2012, on an application moved by petitioner, main revision was restored to its original number and was ordered to be listed as per roster. There has been no appearance on behalf of petitioner since 17.11.2017. On resumed hearing today, none causes appearance on behalf of the petitioner. It seems that petitioner is not interested in pursuing the matter further. 3.

Dismissed for non-prosecution.
