2016-02-25Mr. Justice Krishna Murari2 pages

IN THE HIGH COURT FOR THE STATES OF PUNJAB AND HARYANA AT CHANDIGARH.

Cr. Misc. M 42716 of 2015 Date of decision: 25.2.2016 Pal Singh and anr Petitioners vs.

State of Punjab Respondent

Present:

Mr. HS Brar, Advocate.

Ms. HK Athwal, DAG, Punjab.

Mr. Amrik Singh, Advocate.

M.M.S.BEDI,J.

The petitioners are father-in-law and mother-in-law of deceased Gurpreet Singh, who had committed suicide allegedly on having been insulted and humiliated by the petitioners on 31.3.2015 in connivance with their daughter.

A perusal of the police file indicates that statement of Harmesh Singh has been recorded on 31.1.2016 regarding the occurrence of 31.3.2015 when an assault was allegedly made on the deceased by the petitioners, their daughter and son. The deceased appears to have left his house on 4.5.2016, four days after the above said incident. His dead body was found in a canal on 15.5.2015.

After hearing counsel for the parties and going through the record it appears that the intention of the petitioners to compel the deceased to commit suicide when the marriage was only 6 months old, will be a debatable issue. The petitioners have joined the investigation. Custodial interrogation of the petitioners appears to be not necessary for the investigation of the case.

The petition is allowed and it is ordered that in case of arrest of the petitioners, they will be released on bail to the satisfaction of the arresting officer subject to the condition that the petitioners will join the investigation as and when required by the police and will not tamper with evidence or hamper the investigation.
