Petitioner has filed this petition under Section 438 Cr.P.C. for grant of anticipatory bail in case FIR No.138 dated 27.09.2014 under sections 419, 420, 465, 467, 468, 471 and 120-B IPC registered at Police Station Model Town, District Ludhiana. I have heard learned counsel for the petitioner and have gone through the record.

From the record, I find that FIR in the present case has been got registered by Vipul Kaushik, Chief Manager, Punjab National Bank, Ludhiana. A per the allegations in the FIR, present petitioner is the sole proprietor of firm M/s Vinayak Agrotech and he applied for term loan of the sum of `23,66,000/-. Collateral security offered was equitable mortgage of immovable property by deposit of registered title deed of lease hold rights in property No.B-11 1103 measuring 360 VINEET GULATI 2015.02.12 10:22 I attest to the accuracy and authenticity of this document Chandigarh

CRM No.M-4272 of 2015 -2sq. yards owned by Smt.Bina Devi. As per the allegations, the credit loan was given in year 2007 but Bina Devi already died on 02.09.2005. The petitioner was in the knowledge of this fact as Bina Devi was his mother.

Keeping in view the facts and circumstances of the present case, nature and gravity of the offence, I find that no case is made out to grant benefit of anticipatory bail to the petitioner. Therefore, finding no merit in the present petition, the same is dismissed.
