**** RAMESHWAR SINGH MALIK J. (ORAL) Petitioner seeks pre-arrest bail in FIR No.211 dated 9.3.2010 under Sections 395/397/120-B/412 IPC, registered at Police Station City Rohtak, District Rohtak.

Learned counsel for the petitioner submits that when the petitioner was on regular bail, he had been regularly appearing before the learned trial court. However, on 26.8.2015, petitioner had to move an application for exemption from personal appearance because he was unwell but the said application came to be dismissed by the learned trial court vide Annexure P-2. He further submits that petitioner is ready and willing to surrender before the learned trial court and it may be directed to consider the bail application of the petitioner keeping in view all the attending circumstances which shall be brought to its notice at the instance of the petitioner, within reasonable time.

Criminal Misc. No. M-42731 of 2015 After hearing learned counsel for the petitioner and without expressing any opinion on the merits of the case, lest it should prejudice the case of either side, at a later point of time, present petition is disposed of with a direction to the petitioner to surrender before the learned trial court within a period of one week from today. On surrender by the petitioner, learned trial court shall admit him to regular bail by passing an appropriate order, at an early date and keeping in view the totality of facts and circumstances of the case which shall be brought to its notice, at the instance of the petitioner, including the fact that his application for exemption from personal appearance was declined, but in any case within a period of one week from the date of surrender by the petitioner. With the abovesaid observations made above and directions issued, present petition is disposed of.
