CRM-M-42796-2017 Date of decision: 13.11.2017 Bali Singh and another ..... Petitioners

Versus

State of Punjab and another ..... Respondents

CORAM:

HON'BLE MR. JUSTICE RAMENDRA JAIN PRESENT: Mr. BS Jaswal, Advocate for the petitioners. RAMENDRA JAIN, J. (ORAL) Through this petition under Section 482 Cr.P.C., the petitioners have sought a direction to respondent No. 2-Senior Superintendent of Police, Amritsar (Rural), to look into their request dated 14.09.2017 (Annexure P-2) and to direct respondents No. 2 and 3 to serve advance notice upon the petitioners in terms of Section 160 Cr.P.C., in case, they are required in any enquiry or investigation.

Learned counsel for the petitioners inter alia contends that they are the lawful owners of the property in question. Even the Civil Court has put seal on their title and possession over the property in question. Respondents No. 2 to 5, under the garb of enquiry/investigation, are harassing the petitioners since long without any rhyme or reason. Considering the overall facts and circumstances, respondents No. 2 to 5 are directed, not to call the petitioners under the garb of enquiry/investigation, unless one weeks' advance notice is served to them under Section 160 Cr.P.C.

The instant petition stands disposed of, accordingly. November 13, 2017 ( RAMENDRA JAIN ) rishu JUDGE Whether speaking/reasoned Yes/No Whether Reportable Yes/No Rishu Kataria 2017.11.14 15:02 I attest to the accuracy and authenticity of this document
