This order shall dispose of the above mentioned two petitions filed on behalf of petitioners Jagpreet Singh @ Jaggu and Ran Singh seeking grant of
( 2 ) CRM-M-26169-2021 (O&M) & ancitipatory bail in respect of a case registered vide FIR No.142 dated 30.9.2020 at Police Station Khemkaran, District Tarn Taran, Punjab under Sections 307, 341, 323, 324, 326, 506, 148, 149 of Indian Penal Code and Sections 25, 27 and 54 of Arms Act, wherein they came to be nominated on the basis of supplementary statement recorded after about 10 days of the occurrence although as many as 15 persons had already been named at the time of recording of the FIR.

At the time of issuance of notice of motion (in CRM-M-26169-2021) on 23.7.2021, the following order was passed:
"Learned counsel for the petitioner contends that the petitioner is nowhere named in the FIR, wherein as many as 15 persons have been specifically named. It has further been submitted that subsequently upon the statement of another injured Salwinder Singh as many as 5 more persons have been roped in namely Nawab Singh, Ran Singh, Jaggu, Ranjit Singh and Sukhraj Singh, who are all alleged to have been armed with baseball bats and are stated to have caused injuries to Salwinder Singh and Jaimal Singh. It has been submitted that the aforesaid statement was recorded after about 10 days of the occurrence and is apparently an after thought naming a larger number of persons from the opposite party as accused.

Meanwhile, in the event of arrest, the petitioner be released on interim bail subject to his furnishing personal bonds and surety bonds to the satisfaction of Arresting/Investigating Officer. However, the petitioner shall join the investigation as and when called upon to do so and cooperate with the Investigating Officer and shall also abide by the conditions as provided under Section 438 (2) Cr.P.C."

Similar order was also passed on 23.8.2021 in CRM-M-34249 of 2021. 4.
Learned State counsel, upon instructions from ASI Major Singh, has informed that pursuant to interim directions issued by this Court, the petitioners have since joined investigation and are not required for any custodial interrogation. It has, however, been informed that the petitioners stand involved in one more FIR lodged for offence under Section 323 IPC etc.

Keeping in view the aforestated position particularly the fact that the petitioners came to be nominated on the basis of supplementary statement recorded much after lodging of the FIR and that the petitioners have already joined investigation and are not required for any custodial interrogation, both the petitions are accepted and the interim directions issued by this Court vide orders dated 23.7.2021 and 23.8.2021 are hereby made absolute, subject to the condition that the petitioners shall join investigation as and when called upon to do so and cooperate with the Investigating Officer and shall also abide by the conditions as provided under Section 438(2) Cr.P.C. 6.
