(Oral) Learned counsel for the petitioner states that inadvertently, in paragraph 3 it has been mentioned that after completion of investigation challan has been presented by the police against the petitioner and charge has been framed and trial is pending for recording of prosecution evidence for 17.10.2017. He states that as a matter of fact the FIR is at the stage of investigation and as such he be allowed to withdraw the present petition, granting him liberty to file a fresh one, giving correct factual position. Allowed. Dismissed as withdrawn with liberty aforesaid. ( H.S.
