(Oral) Prayer in this petition is for grant of regular bail to the petitioner, in a case arising out of FIR No. 156 dated 19.10.2016, registered at Police Sadar Tarn Taran, District Tarn Taran, who has been booked for having committed the offence punishable under Section 376/452 IPC.

The allegation against the petitioner is that he entered the house of the complainant and committed rape upon her forcibly. Learned counsel for the petitioner submits that the husband of the complainant is enmical towards the petitioner because of some old grudge and thus, he tried to involve the petitioner in the present case. Further the complainant appeared in the Court and got her statement recorded where she denied about the above said occurrence. Learned State counsel has admitted the above said fact that the complainant denied that the petiitoner committed rape upon her. Crl. Misc. No. M-43723 of 2016 -2Learned State counsel on instruction from ASI Jagbant Singh has further informed the Court that the challan is yet to be presented. Heard.

Petitioner is in custody since 17.06.2016 Keeping in view the fact that the trial is likely to take some time to conclude and the fact that the complainant has turned hostile, the present petition is allowed. Petitioner is ordered to be released on bail during pendency of the trial of the present case, subject to his furnishing bail bonds to the satisfaction of the Chief Judicial Magistrate/Duty Magistrate, Tarn Taran.
