**** RITU BAHRI , J. (Oral) Petitioner is seeking quashing of impugned list B (Annexure P-4) issued by HPSC whereby the candidature of the petitioner has been rejected on the sole ground that printed copy of the application form of the petitioner could not be submitted with respondent Commission in the stipulated period. Pursuant to advertisement dated 23.02.2016 (Annexure P-1), the petitioner applied online for the post of Account Officer Class II in DHBVNL but petitioner could not submit the printed copy of application form along with documents and thus she was not interviewed. There was no written examination for the above post, as informed by learned counsel for the petitioner.

Learned counsel for the petitioner submits that non-submission of printed copy of application form could not be made a ground to debar the petitioner from participating in the selection process. On a specific query put by this Court, learned counsel for the petitioner is not being able to tell the date of list B (Annexure P-4). However, he submits that interviews were held on 01/02.05.2019 and final result was declared Gaurav Arora 2019.05.

In view of the above factual position, at this stage no ground is made out to quash list B and the petitioner will only have a right, if any post remain vacant. The petitioner cannot be held to be not entitled only on the sole ground of non submission of application form on time, as she had also applied online. The present petition stands disposed of with a liberty to the petitioner to approach this Court if any selected candidate does not join.
