(Oral) Learned counsel for the appellant-State of Punjab, at the very outset, fairly states that since the present appeal is squarely covered by the order dated 5.5.2009 passed by this Court in RFA No. 4176 of 2002 (Harbhajan Singh Vs. State of Punjab), let it be disposed of in terms thereof.

In view of the abovesaid fact situation obtaining in the present case, coupled with the statement made by learned counsel for the State, present appeal is ordered to be disposed of in terms of order dated 5.5.2009 passed in Harbhajan Singh's case (supra). Disposed of, accordingly.
