The instant petition has been filed by the petitioner against the concurrent findings of the Courts below whereby the trial Court has convicted the petitioner for offence under Section 500 IPC and released him on probation for one year under Section4(1) of Probation of Offenders Act along with a fine of Rs. 1000/- and the lower Appellate Court has upheld the judgment and order of ld. Trial Court.

Learned counsel for the petitioner submits that the petitioner has since expired and placed on record a copy of death certificate of the petitioner in the Court today, which is taken on record.
