(Oral) The Court has been convened through video conferencing due to Covid-19 pandemic.

Petitioner was married to respondent No.3 on 26.09.2009 and a son was born out of the wedlock on 16.05.2011. The husband of the petitioner was of an unsound mind. He used to physically abuse the petitioner and her son and sometimes, even hit his mother. He was getting treatment from Mental Hospital. Due to the harassment at the hands of her husband, the petitioner left the matrimonial home a couple of times but used to always return after a few days as she did not get any support from her parental home. After the situation became extremely unbearable, she left the matrimonial home with her son on 16.04.2017 and started residing in Vikas Puri, New Delhi, where she started working as a domestic help. Due to the outbreak of Covid-19, the conditions in Delhi became difficult and she lost her job, leaving her with no income.

She shifted back and started living with her mother at Batala. She apprehends threat to her life and liberty at the hands of her in-laws/respondents No.4 to 7, who, she fears, may forcibly take away her child. Before approaching this Court, she has submitted a representation dated 24.07.2020 SAVITA KADIAN 2020.08.

CRWP-5474-2020 {2} (Annexure P-1) to the Senior Superintendent of Police, Gurdaspur seeking protection for herself and her minor son, but the representation has remained unattended.

Counsel for the petitioner submits that at this stage, the petitioner would be satisfied, in case a direction is issued to the concerned official respondent to look into the representation submitted by her.

The submission made by the petitioner is just and reasonable.

Without going into the allegations levelled by the petitioner in the writ petition or in her representation, the present petition is disposed of with a direction to the Senior Superintendent of Police, Gurdaspur-respondent No.2 to examine the representation dated 24.07.2020 (Annexure P1) and thereafter, to take appropriate steps as warranted in accordance with law. In case, it is found that there is any imminent threat to the life and liberty of the petitioner and her son, then it be ensured that no harm is caused to the petitioner or her son.

A copy of the order along with copy of the representation dated 24.07.2020 (Annexure P-1) be sent to the Senior Superintendent of Police, Gurdaspur-respondent No.2 to enable him to do the needful expeditiously.

Disposed of.
