This is a petition filed under Section 439 Cr.P.C. for grant of regular bail in case FIR No. 25 dated 20.04.2022 registered under Sections 307, 323, 42, 148, 149, 120-B of IPC and Section 25/27/54/59 of Arms Act, at Police Station Mattewal, District Amritsar. The FIR was lodged on the complaint of one Joga Singh, who stated that he is the area in-charge to Aam Adami Party of Majitha circle. He had sought an information under the Right to Information Act from the office of BDPO regarding Panchayat Fund and MNREGA labour payments made in village Taharpur. Due to this, the petitioner who is Sarpanch of the village through Gurjit Singh, Arshjot Singh and Yadwinder Singh threatened the complainant with dire consequences if he did not compromise with the father of Arshjot Singh. It is alleged that on 22.4.
2022 the complainant along with his mother was present in the courtyard of his house. At about 5 p.m, Gurjit Singh along with Arshjot Singh armed with a revolver, Yadwinder Singh SATYAWAN 2022.07.22 19:22 I attest to the accuracy and authenticity of this document armed with a pistol entered into his house.
CRM-M-24499-2022 (O&M) -2where upon Arshjot Singh and Yadwinder Singh fired at the complainant with an intention to kill him. However, the shot did not hit him. He immediately entered the room. Thereafter, on alarm being raised, the accused fled away along their weapons.
Mr.D.S. Gandhi, learned counsel for the petitioner states that the petitioner is in custody since 21.04.2022. He further states that in fact even from the complaint it is apparent that the dispute was between Arshjot Singh and Joga Singh. The petitioner has no role or concern therewith. Arshjot Singh has already been arrested and the pistol has been recovered from him. The petitioner has five month old child. It is further stated that a compromise has also been entered between the complainant and the petitioner. Keeping in view the above, no useful purpose would be served by keeping the petitioner behind bars. Hence, petition is allowed. Petitioner Baljit Kaur is ordered to be released on bail on her furnishing bail bonds/surety bonds to the satisfaction of learned trial Court/Duty Magistrate concerned.
