**** HARNARESH SINGH GILL , J. (ORAL) Case is being taken up for hearing through video conferencing. The petitioner seeks regular bail in FIR No. 234 dated 19.8.2019 under Section 306 IPC, registered at Police Station Jamalpur, Ludhiana, District Ludhiana.

Learned counsel for the petitioner submits that petitioner had performed love marriage with Shivani in the year 2017 and they were residing in a rented accommodation and out of the said wedlock a girl child was born. Learned counsel further states that the deceased was under depression because of regular threats given by her parental family as she had solemnized marriage with the petitioner against their wishes and there is no suicide note and the minor child is residing with the parents of the petitioner. He further submits that the petitioner has been in custody since 19.8.2019.

CRM-M No. 21374 of 2020 -2has been presented but charge is yet to be framed. Custody certificate by way of affidavit of Deputy Superintendent, Central Prison, Ludhiana dated 13.8.2020 has been filed through e-mail. Copy of the same has been taken on record. As per the custody certificate, the petitioner has been in custody from the last 10 months and 24 days. In the present case, challan has been presented but charge has not been framed yet. The trial will take time to conclude. No useful purpose would be served by keeping the petitioner behind the bars.

Without commenting anything on the merits of the case, the petition is allowed and the petitioner is ordered to be released on bail on his furnishing bail/surety bonds to the satisfaction of the trial Court/Duty Magistrate.
