Present petition under Section 439 Cr.P.C. for seeking regular bail to the petitioner(s) in case FIR No. 73 dated 4.8.2017, registered under Section(s) 306 & 34 IPC at Police Station Mulepur, District Fatehgarh Sahib.

Learned counsel for the petitioner contended that petitioner has been falsely implicated in the present case; he is in custody since 4.8.2017 and more so, his co-accused, namely, Harjit Singh was released on bail vide order dated 31.10.2017, passed by this Court in CRM-M-31841-2017. Learned counsel further contended that decision of the case still to take some more time; thus, present petition be accepted and petitioner be released on regular bail.

Criminal Misc. No. M-42918 of 2017 detention of the petitioner in this case and opposed the prayer made. Having considered the fact that the petitioner is in custody since 4.8.2017; trial of the case still to take some more time and co-accused, namely Harjit Singh has already been released on bail by this Court, present petition stands accepted. Petitioner is ordered to be released on regular bail on his furnishing bail and surety bonds to the satisfaction of the learned trial Judge/Duty Magistrate, Patiala.
