(ORAL) In the present writ petition, the claim of the petitioner is that though he retired as Chowkidar from the office of the Municipal Council, Sunam on 30.11.2017 after rendering more than 36 years of service, but till date all his benefits for which he was entitled for, have not been released. In paragraph 2 of writ petition, it has been stated that still an amount of `6,79,785/- is due to the petitioner and the respondents have allowed only 90% pension to the petitioner instead of 100%. Counsel for the petitioner states that there is no impediment for the release of the said benefits as no departmental enquiry or any other proceeding is pending against the petitioner, which would entitle the respondents to withhold the benefits. CWP-12303-2019 -2has served the respondents with a legal notice on 07.01.2019 (Annexure P-3), which is still pending consideration with the respondents and the petitioner will be satisfied, at this stage, in case a time bound direction is issued to the respondents to decide the said legal notice. In view of the request made, without expressing any opinion on the merits of the case or the claim being made by the petitioner, the respondents are directed to decide the legal notice dated 07.01.2019 (Annexure P-3) by passing a speaking order within a period of three months from the date of receipt of a certified copy of this order. In case after the decision, it is found that the petitioner is entitled for any monetary benefit, the same shall also be released to him within a period of next three months.

Present writ petition stands disposed of.
