-.- JAISHREE THAKUR J. (ORAL) This is a petition that has been filed for grant of regular bail in case FIR No.0118 dated 27.06.2020 registered under Sections 379-B, 148, 149 IPC at Dugri, District Ludhiana.
Counsel for the petitioner herein at the very outset would contend that the petitioner has been declared a corona positive and in support of his averment, shared details of the medical report on the Whatsapp group, which is taken on record.
Without going into any of the other contensions raised by counsel for the petitioner, this Court deems it appropriate to direct release of the petitioner forthwith. The instant petition is allowed and the petitioner is directed to be released on regular bail on execution of adequate personal/ surety bond to the satisfaction of concerned trial Court/Duty Magistrate. Needless to say in case the medical report is found false, the State would be at liberty to apply for cancellation of bail. Let a copy of this order be sent by fax/e-mail today itself.
