RAMENDRA JAIN, J. (ORAL) Case has been taken up for hearing through video conferencing due to pandemic Covid-19.

Through this petition under Section 439 Cr.P.C., petitionerGurwinder Singh, has prayed for grant of regular bail in case FIR No. 163 dated 26.09.2019 registered under Section 22 of the NDPS Act at Police Sation Sadar, Bathinda.

According to prosecution, on 26.09.2019, villagers of village Balluana, caught red handed the petitioner, while selling prohibited and selling intoxicant tablets in the village and handed over him to the police. During his search, two boxes of tablets i.e. one box of Clovidol-100 SR (Tramadol) containing 33 strips of 10 tablets each in total 330 tablets and second box of CDOL (Tramadol) containing 49 strips of 10 tablets each in total 490 tablets, were recovered from him, without any permit or RISHU KATARIA 2020.08.13 16:28 I attest to the accuracy and integrity of this document

Learned counsel inter alia contends that petitioner has falsely been implicated in the instant case, due to some political rivalry. Petitioner is in custody since 11.08.2019. Conclusion of trial may take long time. No useful purpose would be served by detaining him in jail. On the other hand, learned State counsel vehemently opposed the submissions of learned counsel for the petitioner. Having given thoughtful consideration to the rival submissions, this Court is not inclined to grant bail to the petitioner, inasmuch as, recovery of contraband from him falls under the definition of 'commercial quantity'. More so, drug trafficking in this Northern region of the country has increased manifolds in the recent past and, thus, such type of crime has to be dealt with severe hands. Dismissed.
