(ORAL) At the me of filing of the present peon, the charges were not framed but given the absence of stay, the trial Court proceeded further and framed charges. Once a judicial order framing of charges has been passed, it is for the accused to challenge the same. Needless to say that FIR cannot be quashed if a judicial order framing of charges has been passed, which is not even challenged, whereas, a vice versa would happen.
At this stage, counsel for the peoner submits that the revision peon has been filed challenging the charges.
Given above, the present peon is not maintainable, the same is disposed of.
It is clarified that filing and disposal of the present peon shall not come in the way while considering the criminal revision peon challenging the framing of charges. All pending miscellaneous applicaons, if any, stand disposed of.
