As per allegations the police party intercepted the petitioner alongwith his co-accused father-Mukhtiar Singh and his wife Shinderpal Kaur on a scooter. The petitioner is alleged to have fled away while rest of two accused/family members were arrested and recovery of 20 grams of heroin was effected.
It is contended that a false case has been planted upon the petitioner. It is further submitted that both co-accused have since been released on bail and no recovery is to be effected. CRM-M 42891/2015 Learned State counsel on instructions from HC Makhan Singh submits that pursuant to the direction dated 5.1.2016, petitioner has joined investigation and his custodial interrogation is no longer required.
In view of the above, interim protection/bail granted vide order dated 5.1.2016 is made absolute.
